Native Title Law Reform Australia Essay
Mabo and others v State of Queensland (No.2 (1992) HCA 23, is apparently one of the most renowned local title claims in Australian history. This case was the first in Australian history to effectively topple Terra Nullius and basically prompted the production of the Native Title Act 1993 (Cth) (ââ¬ËThe Actââ¬â¢). Land nullius implies land having a place with nobody or land that has never been dependent upon sway of any state and is a piece of International Law. Most of Indigenous People see land nullius in an antagonistic manner, as this term had been utilized as a methods for defending intrusion or takeovers of customary land. The consequence of land ââ¬nullius on ATSI (Aboriginal and Torres Straight Islanders) implied that they have endured incalculable wrong doings and shamefulness towards them. ATSI were not seen as legitimate Australian residents as per the law until 1967. This implied the law offered no security of fundamental human rights or land rights bringing about enormous misfortunes of profoundly noteworthy land. The principal case to make lawful move over land rights was the 1971 Gove land rights case. The Yolngu individuals made lawful move against Nabalco Mining Company in the Northern region Supreme Court. The Yolngu individuals asserted that Nabalco Mining were unlawfully mining on their property (the Gove landmass) without endorsement. Anyway various set backs were experienced, for example, land nullius not taking into consideration local title and the Doctrine of Reception which adequately delineated that once a nation (for this situation Britain) has a colonized an area, that countryââ¬â¢s law currently consequently applies, overruling any past laws that were once set up. For the Yolngu individuals this sadly implied their case was dismissed in 1971 (by Justice Blackburn) as the Australian legitimate framework didn't need to comply with Native Yolngu land laws. This created additional social separation between the Indigenous standard law and the English legitimate framework. ââ¬Å"Native title is the privilege of Indigenous individuals to their conventional land.â⬠(Cambridge Legal Studies, starter, pg 98). The English legitimate framework had a totally different methodology when it came to property rights, Aboriginal Peoples separated land as per the measure of room expected to accommodate countless individuals in understanding to how much food there was accessible here, for instance families living close to seaside regionsâ need far less space to discover food than a faction living in the outback as food there is rare, this is the means by which land was isolated. Were rather than the English framework we see singular property rights Eddie Mabos deep rooted fight for social, human and land rights for the Torres Straight People is a commendable one despite everything recalled today as the primary fruitful case of Native Title and the first toppling of land nullius. The Doctrine of gathering made the test of demonstrating conventional possession much progressively troublesome dissimilar to past cases, for example, the 1971 Gove land rights case. Murray Island was diverse Murray Island had particular fringes; it additionally had a legendary God called Malo (articulated Mare). Malo is the wellspring of Meriam legacy and culture. Malo can be viewed as a type of Common Native Law. Land possession, obligations; strict convictions and ceremonial moves were totally secured inside Malo law giving the foundation of a full of feeling body of evidence against the province of Queensland. Malo has existed for whatever length of time that the Island and its Native People and was in this manner a substantial bit of proof in both Mabo cases. Eddie Mabo had the option to demonstrate that land was passed down from father to child, age to age because of Malos law and inborn moves. ââ¬Å"Malo, or Bomai, which is his mystery and progressively sacrosanct name, built up the laws which announced that groups must keep to their own ways, ââ¬Ëswim with their own kindââ¬â¢, sow their properties and monitor the oceans. â⬠From Malo â⬠Bomai point in Mabo â⬠The Native Title Revolution. The full of feeling measure for accomplishing equity includes various components each being related of each other and just when utilized all in all can are they of any great effect. While evaluating the adequacy of Native Title Law Reform reasonableness, uniformity, access and effectiveness should be thought of. As decency has been a huge issues of worry for Aboriginal People in the Past, Civil debates including Aboriginal land rights absolutely asks the inquiries of who is to blame? When making legitimate move for Native Title asserts the offended party must demonstrate that they possessed the land already and are consequently qualified for guarantee it. Weight of confirmation has not been reasonable in this circumstance as the Traditional Land was not gotten legally yet was taken from underneath them without an any grounds to be taken seriously. Along these lines if this framework were to be reasonable than it ought to be up to the ownersâ of the land to demonstrate they stopped by the land in concurrence with Traditional Indigenous Owners. The subsequent issue is uniformity. Uniformity is hard to accomplish as the law can prompt bad form if everybody is dealt with the equivalent. Impeded individuals may incorporate, Indigenous and Torres Straight Islanders, youthful, monetarily burdened and the old, the equivalent might be applied to get to. Lastly productivity, proficiency implies weighing up the expense of accomplishing an objective for instance money related cost, time, and HR all include and if the expense exceeds the outcome than that at times can be viewed as a negative outcome. All in all means to fixing past harm and foul play perpetrated upon the Aboriginal And Torres Straight Islander People are advancing yet it is still extraordinarily hard for ATSI individuals to guarantee any pay on account of huge weaknesses in all parts of the law. Assets are exorbitant and access can be hard for certain individuals in their circumstance accordingly they are as yet being placed second best according to the law and Justice has not been accomplished for the ATSI individuals implying that albeit Native Title Law Reform is a positive development we despite everything have an exceptionally long approach before obvious equity is reached. Reflecting Paper of The Case of the Mismanaged Ms Essay
Reflecting Paper of The Case of the Mismanaged Ms - Essay Example Ed Coulter, the Vice President of showcasing conceded that he had fronted Dick to fill the situation rather than Ruth since Dick was a man, and since men will in general be in most production line settings, he expected that Dick could relate better to customers. In as much as both Dick and Ruth had equivalent capabilities required for the activity, Ed contended that ladies were not dependable at more elevated levels since they could get pregnant, or forsake their employments so as to follow to their spouses dependent on their husbandsââ¬â¢ occupations or profession (Seymour, 1987). From all these, it is obvious that Ed was one-sided against Ruth. It is illegal to deny ladies openings since they are foreseen to get pregnant. From Ruthââ¬â¢s and Barbaraââ¬â¢s discussion, it is obvious that Triton doesn't advance governmental policy regarding minorities in society. The organization has neglected to regard ladies and view them as notable individuals who can increase the value of the organization and society on the loose. Most importantly, Ruthââ¬â¢s disclosure that ladies in Triton Company structure just 20% of the considerable number of workers is stressing. Furthermore, there are just two ladies holding mid-level administrative situations, with no lady holding a situation at the top official level (Seymour, 1987). This is a reasonable exhibit that ladies are oppressed and their essence in the organization isn't considered of significant worth. Also, I am amazingly stunned to hear Ruthââ¬â¢s objections with respect to the way in which Ed tends to her. At the point when Ed meets Ruth toward the beginning of the day and doesn't welcome her, however remarks on her pullover, her method of dressing, just as her eyes (Seymour, 1987), it serves to be an away from of inappropriate behavior. Ed does this deliberately with goals of causing Ruth to feel awful. This is an unsatisfactory conduct that ought not go on without serious consequences in any workplace. It is likewise significant that there are no unmistakable methods that are being followed while advancing representatives. This is ascribed to the way that data with respect to such open doors are passed by overhearing people's conversations. No proper correspondence is given to existing workers to empower forward their applications to these positions. Rather, the Vice Presidents of different divisions (every one of them are men) plunk somewhere around themselves and pick who to fill the situation with. It stresses that in all the cases they have delegated just men, some of whom have not worked for the organization contrasted with ladies at their level (Seymour, 1987). This presents a few inquiries that request answers. For example, one might need to know, what job the Human Resource Manager of the organization plays in the event that she isn't engaged with the employing procedure. Moreover, one may address why the Vice Presidents consider giving these empty situations to men who d on't merit them, forgetting about dedicated and accomplishing ladies. These demonstrations of segregation if not all around dealt with can be incredibly unfortunate to the organization. To begin with, the organization may confront a few separation claims which may scratch its open picture. The claims may uncover what's going on in the organization and disheartened splendid, persevering and accomplishing ladies who had wished to be a piece of the Triton workforce. Furthermore, the organization may come up short on an assorted official staff. Inability to consolidate ladies in its activity may hurt the organization since considers have uncovered that remembering ladies for the official staff and having assorted variety is interrelated with better execution. This is on the grounds that disparate

The Mental Impairment And Unfitness Act - 1285 Words
The 1997 Mental Impairment and Unfitness Act has been effective in helping courts to determine persons to place on supervision. However, the determination of whether the policyââ¬â¢s goals are being accomplished in relatively difficult because a huge number of mentally ill offenders are being downgraded to extended status during custodial supervision orders. Moreover, offenders who have been released into the communityââ¬â¢s care have been granted such measures through revocation of supervision orders. In contrast, the Mental Health Act 2000 has helped in determining how an individual should be processed through the criminal justice system or mental health system instead of his/her mental health issues. However, this legislation has several challenges including the likelihood of mentally ill offenders to receive unsuitable sentences because of being processed by a mainstream non-specialized Court (Hunter, n.d.). The offenders are usually punished for offenses they were not criminally responsible or cannot remember involvement in it. Problems in Australiaââ¬â¢s Criminal Justice System In essence, it is quite clear that Australiaââ¬â¢s criminal justice system has inherent problems in dealing with issues related to mentally ill patients. One of the major problems is likelihood of inappropriate sentences or unsuitable punishment for crimes. This problem is likely to arise from the legal requirement of the offenders to process a mainstream non-specialized Court. Reconstruction And Renewal Of Paris Represented The ...
Haussmann s reconstruction and renewal of Paris represented the ââ¬Ëtriumphââ¬â¢ of middle class urban culture and value of open, accessible social spaces and a drastic improvement in the living and sanitary conditions of the city. The middle class was deeply involved in the idea of a large social sphere in order to talk and discuss all aspects of life, and the renewal of Paris with open spaces and large boulevards enabled this sphere. The unsanitary and unlivable conditions of the city previously were completely changed, which demonstrates a triumph for the middle class as they gained a clean and safe environment that separated them from the lower working class. Middle class urban values and cultures are centered around the idea of the social sphere. The social sphere allowed literate men to gain more knowledge and broaden their ideas and worldview through interaction with other men of a similar level of intelligence. This began in coffee houses, which served as a place of gat hering in which people could meet up for conversation and discussion, and also allowed them to give their own knowledge to others, which increased the general intellect level of the bourgeoisie. Having this area and space in order to truly experience the social sphere was a main value of the middle class, and this is reflected in the opening up of Parisian streets and boulevards. Haussmannââ¬â¢s plan to create large, open boulevards lined with trees, public parks, and an easily accessible city directly alignsShow MoreRelatedOne Significant Change That Has Occurred in the World Between 1900 and 2005. Accounting BHP Billiton and Santos Limited
Question: Discuss about the Accounting BHP Billiton and Santos Limited. Answer: Introduction Conceptual framework has been hailed as a significant tool for reducing discrepancy and bringing higher corporate reporting parity. The conceptual framework is an ambitious project which allows for the basic tenets with regards to accounting norms so as to meet the information needs of investors, suppliers and creditors. Considering that the underlying basis of accounting standards prevalent in the respective nations would be derived from the principles outlined in the framework, it would also encourage accounting standards harmonisation while providing flexibility for meeting localised needs (Melville, 2013). The accounting standards in Australia are dictated by Australian Accounting Standards Board or AASB and since these are based on IFRS, hence the various principles outlines in the conceptual framework are also taken care of (Deegan, 2014). Considering the above, the report aims to opine on the adherence of the AASB standards and the underlying conceptual framework by considering the annual report of BHP Billiton and Santos Limited. Both of these are mining companies based in Australia. Also, the report would focus on the conceptual framework revision to reflect prudence and the underlying implications. Additionally, the disclosure made by the underlying comparison and a comparison of the same is also included. Annual reports compliance For the purpose of this report, the latest available annual report in the public domain has been considered to evaluate whether these adhere to the conceptual framework and compliance. Before moving forward, it is worthwhile to consider AASB standards in relation to significant items in the companies that have been chosen. AASB 116 PPE With relation to recognition, measurement and reporting of plant, property and equipment, the relevant directions are provided by the given accounting standard. As per this, only those assets must be recognised which are likely to bring in future economic benefits and also measurement of cost in a reliable manner is possible. With regards to initial measurement of any PPE, AASB 116 directs that to be carried out at initial cost. However, in relation to measurement at a later stage, measurement may be carried out either using initial cost or revaluation as may be deemed fit by the reporting entity. But, it is imperative that the underlying choice must not be limited to singly assets but should encompass the complete asset class (AASB, 2010a). AASB 102- Inventories The measurement of inventories as per AASB 102 must be carried out using either the FIFO or weighted average method only. Also, inventory having same nature must have same method of measurement. Besides, the valuation of inventory must be made at lower of the cost and the actual value realisable at the given time (AASB, 2015). AASB 136=Asset Impairment The underlying assets valuation does not remain constant. Hence, AASB 136 recommends that infinite life intangible assets along with goodwill must be subject to impairment testing on an annual basis. Besides, other intangible assets and all tangible assets should undergo impairment testing in case of existence of any information that may hint towards the same (AASB, 2010b). AASB 137- Contingent Liabilities It is required that the underlying entities in their annual report must capture potential obligations expected to arise in the future that is expected to be outside their control. Additionally, any potential obligation that has arisen in present but has unreliable measurement would also be reflected in the form of contingent liability (AASB, 2010c). BHP Billiton The adherence of the company with the above accounting standard coupled with conceptual framework principles is discussed below. AASB 116 The relevant accounting policy extract is shown below (BHP Billiton, 2016). The above policy is fully in line with the relevant accounting standard. Considering the business model of the company, exploration costs are significant and decision needs to be made as to what could be classified as PPE. The relevant policy extract for the same confers with AASB 6 as shown below (BHP Billiton, 2016). The policy stated above tends to pay consideration to the definition of asset as is contained in the conceptual framework and only recognises the exploration costs as assets when the certainty of existence of reserves is established AASB 102 The companys accounting policy for inventory is identified below (BHP Billiton, 2016). The above inventory accounting policy confers with AASB 102. Also, the outline in the conceptual framework is also adhered to in the policy. Additionally, the fact that inventory measurement reflects the actual value is in line with the associated characteristics of information to be extended to the relevant users (Deegan, 2014). AASB 136 The accounting policy for asset impairment is as shown below. The above policy tends to adhere to the AASB 136 and also the broader approach outlined in the conceptual framework. Also, the above policy ensures that only relevant, complete and accurate information is passed on for prudent decision making by relevant users (BHP Billiton, 2016). AASB 137 The accounting policy for contingent liability is as shown below (BHP Billiton, 2016). The policy adhered to by BHP adheres to AASB 137 and ensures that that the conceptual framework is complied with both in letter and spirit thus ensuring prudent decision making by the relevant users. From the description of the policy and the underlying business mode, it is apparent that these may assume significant proportion. Besides, various events that could potentially give rise to liability are also captured as significant events in the annual report (BHP Billiton, 2016). From the above, it is apparent that BHP Billiton through its significant accounting policies not only adheres to applicable AASB standards but also the conceptual framework principles. The most significant testimony of this is provided by the detailed information provided by the company in relation to the Samarco Dam failure and the potential liabilities that may arise due to the same in the present and future (ICAEW, 2006). Santos Limited AASB 116- PPE The companys accounting policy for PPE is identified below (Santos Limited 2016). It is apparent from the above that AASB 116 is adhered to by the company not only with regards to the acquired assets but also for the in-house assets under development, The asset definition as reflected in the conceptual framework is also fulfilled (Deegan, 2014). AASB 102- Inventory The companys accounting policy for inventory is identified below (Santos Limited 2016). AASB 136- Asset Impairment The accounting policy for asset impairment is illustrated below (Santos Limited 2016). The above policy tends to adhere to the AASB 136 and also the broader approach outlined in the conceptual framework. Also, the above policy ensures that only relevant, complete and accurate information is passed on for prudent decision making by relevant users (Santos Limited, 2016). AASB 137- Contingent Liabilities The accounting policy for contingency liability is illustrated below (Santos Limited 2016). The above policy clearly indicates that the policy adhere to AASB 137 and also ensures that future potential liabilities outside the entitys control are also listed. The above analysis of certain segments of significant accounting policies is clearly indicative of the fact that relevant AASB standards are adopted by Santos in the preparation of the annual report. Additionally, the basic tenets of the conceptual framework are also built in which reflects that the information available to the users is timely, accurate and enables prudent decision making. Addition of Prudence The conceptual framework as envisaged originally did not endorse prudence due to the underlying conflict it has with neutrality. Prudence as a concept implies that the management while deploying the various accounting policies and judgement should ensure that revenues are not overstated and liabilities are not understated as there is inherent reason for the company to engage in the same thus inflating profits. The application of prudence is limited to transactions where there are uncertain implications and hence management discretion is needed (ACCA, 2014). Even though the concept itself is not new but its addition in conceptual framework has been mired with controversy and intense debate as on the face it seems incompatible with neutrality. Hence, tweaking has been done in this concept and the same has now been modified to cautious prudence (Deegan, 2014). It is quite likely that prudence as a principle could potentially result in diminishing disparities in corporate reporting as it tends to dampen the aggressive judgement deployed by management in their discretion of certain transactions. Prudence brings about more realism in relation to the management judgement and hence enhances the information quality being released in public. Certain stakeholders have been opposing prudence as they believe that it brings about a negative bias in the financial reporting and thus amounting to misleading the users (ICAEW, 2006). The original concept of asymmetric prudence did have this problem to some extent but the revised concept of cautious prudence requires only cautious judgement from the management and does not endorse negative judgement. Thus, application of prudence ensures reduced deviation in corporate reporting and hence is beneficial to the reporting framework as it assists more accurate decision making by investors and creditors. But the actual benefits of the application of this would only come out when implemented in a manner which ensures a fine balance between neutrality and prudence without violation of either (Melville, 2013). Disclosures Comparison A comparison of the disclosures of BHP Billiton and Santos is as highlighted below (BHP Billiton, 2016; Santos Limited, 2016). In relation to the segmental reporting, detailed information has been offered by both the companies for the various mining assets that these own in the various geographies along with the respective financial results of the same which is highly relevant for the investors. Through the remuneration report, adequate disclosures have been made with regards to the underlying compensation derived by members of the senior management and the respective principles responsible for the awarded remuneration. A significant component of disclosures is the directors report which provides valuable information to the users regarding not only operational and financial performance during the year under review but presents significant takeaways for the future which can be deployed for prudent investment decision making. Based on the financial reports presented, is seems that BHP Billiton tends to more transparent in highlighting more detailed information particularly through notes on management judgment and contingency liabilities. Even though, the management judgement notes to some extent are present for Santos also, but apparently, they are not as frequent and exhaustive as that of BHP Billiton. Conclusion: Based on the above, it is apparent that the current regime in place for reporting of information to relevant users through the application of AASB standards and conceptual framework seem adequate and is also adhered to by the companies chosen for the task. Further, going ahead it is likely that with the addition of prudence, the information reporting may improve further especially for mining companies as there is significant management discretion involved in reporting of various assets and their reserves which has a material effect on the companys valuation. Further, with regards to the underlying disclosures being made by the respective companies, there are not any major differences, but still the overall reporting and detailing for BHP Billiton is comparatively more detailed which to an extent may be linked to the underlying difference in size of operations of the two companies. Why All The Hatred Essay Example For Students
Why All The Hatred? Essay ENGL 1301.02122 October 2002There are many things that affect the way that Americans live today. Racism, discrimination, and prejudice are extensive in our Americanculture. Although racism and discrimination are not accepted as they werein the 1940s through the 1960s, these things still exist in our societyand are still being used socially today. Racism is a belief that race isthe primary determinant of human traits and capacities, and those racialdifferences produce an inherent superiority of a particular race. Inaddition to racism, Americans also tend to be ethnocentric. Americans tendto believe that their race is superior to any others and tend to judgeother racial backgrounds from the perspective of their own ethnicity. Onthe other hand, multiculturalism can be a possible solution to problemslike ethnocentrism and racism. We will write a custom essay on Why All The Hatred? specifically for you for only $16.38 $13.9/page Order now Cultural minorities experience racism as a part of their everydaylife. They are treated differently and discriminated against as if theyare not American. They experience verbal abuse and slander from people ofmajorities. Racism and discrimination go hand in hand, as racism leads todiscrimination. Discrimination is the treatment given based on the class, race, religion etc. of a person. Even if racism and discrimination are notlegal anymore, they still havent been eliminated from todays society. For example, a few decades ago blacks werent allowed to go to the sameschool as whites, they had to sit in the back of the bus and were nottreated as equals. Minorities were not allowed to go to the same school asothers. These are some instances of the ways that the governmentdiscriminated against blacks. Racism in those days was exploited tosuch an extent that only whites were treated in a respectable manner. TheItalians, Irish, and Jews were also victims of racism and discrimination tosome extent. Thus, so much racism is unhealthy for a nations progress asit creates tension in a society and a nation, and keeps us from maintainingunity, keeping peace and helping each other. Ethnocentrism is the belief that ones culture is superior to that ofothers thus judging other cultures as substandard compared to their own. Americans tend to cocoon themselves with their own culture so that no otherculture can penetrate it and open their eyes to a new dimension. Thismakes them less accepting of others and their culture and ethnicity. Narrow mindedness on our side could create confusion, misunderstanding, andthus leading to conflicts in the future. If one could look at othercultures from a different perspective and a broad standpoint there would bemore understanding amongst us as a nation. Multiculturalism is the solution and the bright side to be focusedon. If all the negative aspects like racism and ethnocentrism were to beoverlooked, adding the best of other cultures can enrich American culture. American culture is so diverse and consists of so many cultures andethnicities all over the world. Multiculturalism is bound to eliminateracism and making one more accepting of others and their culture. Thiswould welcome more immigrants, which not only contributes to culturalenrichment but also technological progress. Learning about other culturesand accepting them is bound to broaden our horizons and makes us more open-minded. Thus, for the reasons mentioned above multiculturalism can helpeliminate racism and ethnocentrism. There is an evident need for Americans to come out of their shells, look at the bigger picture, and cease being judgmental. This couldadvocate many positive beliefs in future and getrid of the negative tenets like racism and ethnocentricity. Therefore, multiculturalism should be promoted which with any luck will eventuallyabolish all the cultural negativity in America. .uc4e33de03269bd7b7541a98d1e119ad9 , .uc4e33de03269bd7b7541a98d1e119ad9 .postImageUrl , .uc4e33de03269bd7b7541a98d1e119ad9 .centered-text-area { min-height: 80px; position: relative; } .uc4e33de03269bd7b7541a98d1e119ad9 , .uc4e33de03269bd7b7541a98d1e119ad9:hover , .uc4e33de03269bd7b7541a98d1e119ad9:visited , .uc4e33de03269bd7b7541a98d1e119ad9:active { border:0!important; } .uc4e33de03269bd7b7541a98d1e119ad9 .clearfix:after { content: ""; display: table; clear: both; } .uc4e33de03269bd7b7541a98d1e119ad9 { display: block; transition: background-color 250ms; webkit-transition: background-color 250ms; width: 100%; opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #95A5A6; } .uc4e33de03269bd7b7541a98d1e119ad9:active , .uc4e33de03269bd7b7541a98d1e119ad9:hover { opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #2C3E50; } .uc4e33de03269bd7b7541a98d1e119ad9 .centered-text-area { width: 100%; position: relative ; } .uc4e33de03269bd7b7541a98d1e119ad9 .ctaText { border-bottom: 0 solid #fff; color: #2980B9; font-size: 16px; font-weight: bold; margin: 0; padding: 0; text-decoration: underline; } .uc4e33de03269bd7b7541a98d1e119ad9 .postTitle { color: #FFFFFF; font-size: 16px; font-weight: 600; margin: 0; padding: 0; width: 100%; } .uc4e33de03269bd7b7541a98d1e119ad9 .ctaButton { background-color: #7F8C8D!important; color: #2980B9; border: none; border-radius: 3px; box-shadow: none; font-size: 14px; font-weight: bold; line-height: 26px; moz-border-radius: 3px; text-align: center; text-decoration: none; text-shadow: none; width: 80px; min-height: 80px; background: url(https://artscolumbia.org/wp-content/plugins/intelly-related-posts/assets/images/simple-arrow.png)no-repeat; position: absolute; right: 0; top: 0; } .uc4e33de03269bd7b7541a98d1e119ad9:hover .ctaButton { background-color: #34495E!important; } .uc4e33de03269bd7b7541a98d1e119ad9 .centered-text { display: table; height: 80px; padding-left : 18px; top: 0; } .uc4e33de03269bd7b7541a98d1e119ad9 .uc4e33de03269bd7b7541a98d1e119ad9-content { display: table-cell; margin: 0; padding: 0; padding-right: 108px; position: relative; vertical-align: middle; width: 100%; } .uc4e33de03269bd7b7541a98d1e119ad9:after { content: ""; display: block; clear: both; } READ: Life EssayAlongside, Americans shouldnt judge people by their skin color orreligion but accept them for whom they are, and what background they comefrom. Free Essays on Why Winston Is A Critical Thinker Free Essays on Why Winston Is A Critical Thinker Being a critical thinker isnââ¬â¢t easy. Itââ¬â¢s a skill that has to be acquired over time and practice. Being a critical thinker means that you donââ¬â¢t only look at the facts but you look at an idea from every possible angle, while formulating your own thoughts and meanings. The character of Winston from George Orwellââ¬â¢s 1984 is a perfect example of a critical thinker. Winston is able to think critically about Big Brother, because he is able to formulate his own ideas on what is right and wrong about the partiesââ¬â¢ policies. Winstonââ¬â¢s ideas formulated through thinking critically cause him to revolt against the partiesââ¬â¢ suppression of sex, truth and free deliberation. Although Winstonââ¬â¢s actions lead to his torture, it is safe to say that his critical thinking brings him real life because he is able to think outside the bubble and become an individual. Orwell in relation to Winston was also a critical thinker. In fact, Orwell used the cha racter of Winston to express his own critical views on government, and to influence his audience to become critical thinkers At the start of 1984, the reader learns that Winston the protagonist is living in a harsh and oppressive world, a world were everyone has been brain-washed to think as Big Brother wants them to think, and not as individuals. From the start of the book Winston shows that he doesnââ¬â¢t conform to how the government wants him to act. He is a critical thinker because he doesnââ¬â¢t think like everyone else. All the other citizens just accept that there are telescreens spitting out propaganda and watching their every move, or that Big Brother controls and monitors all actions of their lives. Winston doesnââ¬â¢t conform his ideas like Big Brother wants him to, instead Winston thinks of rebellion and freedom. ââ¬Å"Down with Big Brother,â⬠were the words he wrote in his small diary, a diary which could get Winston in lots of trouble with the Thought Police. Report on International Business Machines Corp (IBM) Case Study
Report on International Business Machines Corp (IBM) - Case Study Example Firstly, there was the disruptive change on the organizationââ¬â¢s culture as a result of the telecommuting. Secondly, there was the problem with the initial technological support. The first issue has been identified by several authors as being a key stumbling for managing successful change efforts (Beer, Eisenstat, & Spector, 1990; Heracleous & Langham, 1996; Johnson, 1992; Kotter, 2007). All these authorsââ¬â¢ viewpoints are looked at within the report. On the other hand, this report does not find the second issue of problems with technological support to be major because while an organization is implementing change one anticipates a state of flux during which systems and technologies have to experience instabilities. Johnson (1992) defined the cultural paradigm as the core set of beliefs and assumptions, held relatively commonly by management and employees, that are specific and relevant to that given organization and that are learned over time. Telecommuting changed the way of doing things at IBM for example some managers lost prestigious privileges such as private offices with private secretaries and team members became physically dispersed which made inter-team communication much harder. The first issue, the negative impact of telecommuting on IBM-Indianaââ¬â¢s cultural paradigm is analyzed using Johnson (1992) cultural web approach. The second issue is largely a technological issue that has to arise as the organization transitions from one stable organizational system to another. Organizational culture and managing change According to Johnson (1992) culture plays a big role in the development of strategy, the management of the resulting strategic change and also on the choices made by an organizationââ¬â¢s leadership that lead up to both strategic development and change. In this case telecommuting presents a major strategic change for IBM-Indiana. The culture web is a tool proposed by Johnson (1992) as a suitable device for conducti ng an organizationââ¬â¢s culture audit. According to Heracleous and Langham (1996) the cultural web allows managers to conceptualize the organization either within an interpretive frame of reference (what the organization is) or as a variable in a functionalist frame of reference (something an organization has). The culture web comprises of seven elements: paradigm, rituals and routines, organizational structure, power structures, control systems, symbolic aspects and stories as shown in Figure 1 below. Almost all the cultural web elements were greatly affected by the introduction to telecommuting. With telecommuting employees had to contend with new rituals and routines for example maintaining accurate and up to date schedule of activities on the computer to enable scheduling of meetings and teleconferences. Formalized control systems that monitor and therefore emphasize what is important at IBM, in order to focus attention and activity also had to be changed to reflect the ne w arrangement of partly off-site and on-site office arrangements. Managers who had private offices and private secretaries lost these huge symbolic aspects of being managers at IBM and the loss of group-work setting diminished opportunities for social contact and casual communication that

A critique of leadership and team management style in the light of Vip Essay
A critique of leadership and team management style in the light of Vip model and other current theories - Essay Example Few decades back, dynamics of a household were rigidly defined as father entrusted with the role of a bread winner, and the mother assigned to be the housekeeper. It was, most assuredly, regarded a womanââ¬â¢s duty to ensure that her husband and children were well taken care of. However, the shifting social, economical, and financial conditions, along with the increasing cost of living, has vastly evolved the thinking process, and has resulted, in many families, both parents working for livelihood. In addition, the deteriorating family structure, increasing poverty, and decreasing sense of security, has also resulted in children, from an early age, suffering from confidence and self-esteem issues. The severity of this situation can be realized from the fact that between years 2004 and 2008, eight hundred new children centers were inaugurated in UK and thirty percent of them were opened in extremely disadvantaged communities (Siraj-Blatchford and Manni 2007).This highlights the sig nificant role played by the nurseries and other early yearââ¬â¢s centers in the support and growth of their respective communities. If a center succeeds in providing a safe, secure, and a neutral learning environment to its children, it not only provides peace of mind to parents, but most importantly leaves an indelible mark on childrenââ¬â¢s lives, and molds them to become better individuals. As the beginning proverb hints, taking proper care of a child requires a collective effort, which can only be possible with appropriate leadership and guidance. Therefore, to run a successful early yearââ¬â¢s center, a manager is required to have certain specific attributes. My interview was based on three themes, which were Vision, Implementation/Operational, and People Manager/Team Management Skills of the managing practitioner. These themes were based on the ââ¬Å"VIP Model,â⬠which was proposed by Mark Hollingworth (2003, p. 34). According to Hollingworth, a true leader is i n fact a ââ¬ËVIP,ââ¬â¢ which stands for ââ¬ËVisionary, Implementer, and a People Managerââ¬â¢. These three primary leadership traits, in the light of other theories as well, will be mostly explored in this portfolio. Various other themes, such as handling parent-staff interactions, curriculum setting, goals of the center, etc. were also considered, but after careful consideration, it was deduced that Hollingworthââ¬â¢s three categories encompasses majority of the themes. For example, parent-staff meetings is a part of ââ¬Ëpeople managerââ¬â¢ category, curriculum setting falls in the ââ¬Ëimplementationââ¬â¢, and goal setting is definitely an element of the ââ¬Ëvision.ââ¬â¢ As shown in Appendix A, The format adopted for the interview was semi-structured, consisting of mostly open ended questions. The justification of using this format was to get a deep insight into the mind of interviewee, and to judge his leadership style according to VIP model and ot her contemporary management theories. In addition, the interview was designed and conducted with the intention of ââ¬Å"establishment of rapport, identification of follow-up questions, and avoidance of leading questionsââ¬â¢ (Partington 2001, p. 4). The conversation was carried out with utmost neutrality, empathy, and without any judgmental and sarcastic connotations. On the whole, the interview was primarily structured to find out if Mr. John Smith, our interviewee, has characteristics of becoming a VIP. It should be noted that, due to confidentiality, the real names of our interviewee and care center are not revealed in this report. The significance of having a ââ¬Ë

Administrator Challenges Essay Example for Free
Administrator Challenges Essay In modern society there are many challenges to police work. They can be very overwhelming but many grant satisfaction. It takes a special individual to be a police officer and perform the duties that are required by law for them to do. This paper will look at the satisfactions and challenges of police work on a day to day basis. One challenge that police officers face daily is the stress that accompanies the job. Many officers face very stressful and intense situations that need to be handled carefully. A police officer may face a crowd that is rioting and looting and is greatly outnumbered. He or she faces the risk of being overrun and this can be detrimental to their emotions. They may be in fear of their life because crowds feed off of each other and can become very aggressive and violent. In some instances the officer will face gunfire and this puts the officer in a life or death situation. See more: Foot Binding In China essay If the officer has to kill the subject then the officer may face Post Traumatic Stress Disorder (PTSD) and this can affect their performance of their daily duties and their personal lives. According to (Gersons, 1989) shooting incidents are a rare phenomenon in low violence police work; however, when a shooting incident occurs, the psychological impact for the officers involved may take the form of severe PTSD (Stewart,2011). There are programs that help individuals to cope with PTSD and can get help from The National Institute for Mental Health. Another challenge that our police officers face on a daily basis is the relations they have with the citizens of the community. Many members of society see the police officers as the enemy or are out to get them. This cannot be further from the truth. The officers need to know how toà communicate with the people in stressful situations. Most people do not realize that officers are called to show up at a residence and it may be the worst day of that individualââ¬â¢s life. Police officers communicate with people from a wide variety of backgrounds, attitudes, and preconceptions (2008). One skill an officer uses at one call may not work at another call. The officer must adapt and control the situation and use his or her training to get the facts and information from the bystanders or the victim(s). With all the challenges and stressors that come with policing there are also satisfactions that come with the job. Officers serve and protect the public. They patrol the streets to ensure the community is safe from would be offenders or to apprehend the ones that have already committed crimes. They take individuals of the streets that are a danger to society. They help people that may have a flat tire, domestic disputes, or have had their home broken in to. The officers feel satisfied when they capture the suspect and when they help people in need. When the officers are recognized for their good work they are satisfied with their job and may become more motivated to improve their performance on the job. Many strive to climb the ranks and with each promotion come more satisfaction. A career in law enforcement in itself is a satisfaction that many people do not get. Many officers do not do the job for the pay but rather the rewards that come with the job in serving and helping the community. Certain officers find it very rewarding when they can help a juvenile down the right path and to possibly mentor others from making life changing mistakes. Officers need to stay positive in their work and duties to ensure job satisfaction because it can affect the work they perform and also affect community relations as to how they see the police. Thus, poor performance can impact police-community relations by adversely affecting public attitudes toward the police (Buzawa, Austin, Bannon, 1994). In the routine of having a positive work attitude and environment it creates less stress levels and fewer symptoms of stress that can lead to absenteeism, burnout, and alcoholism. There are many reasons why people do not want to become part of the law enforcement community but there are a lot of reasons and rewards why other people feel they are being called to serve and protect. Officers face manyà challenges every day from life threatening to resolving domestic disputes. They forever have a family in blue and will always share each otherââ¬â¢s pain and satisfactions. Even though there is an age requirement, alcohol should be banned because it leads to drunk driving and kills. Here in the state of Missouri, statistics show that in 2011, 9,878 people died in drunk driving crashes. One crash every 53 minutes. There are two types of drunk driving offenses. One is DWI, which is driving while intoxicated. The other is the DUI, driving under the influence, which would be of alcohol or other drugs. They both follow the same rules and laws. Here in Missouri, we have strict laws and offenses that limit drunk driving. The legal blood alcohol level for driving is a maximum .08% if you are over the age of 21 and .02% for minors under the age 21. A first offence for driving while intoxicated is considered a class B misdemeanor. Class B misdemeanors can vary from 30 days up to six months in jail, up to $500 in fines, or both. A second offense within five years of the first violation is a class A misdemeanor and is serving up to 1 year in jail, a $1,000 fine, or both. A third conviction for DWI in your lifetime is a class D felony and you serve 4 years in prison, a $5,000 fine, or both. Previous laws in Missouri used to require that the first offense would have occurred within 10 years of the 3rd offense, but now it is a lifetime look back. A fourth conviction is a class C felony and is punishable by up to 7 years in prison, a $5,000 fine, or both. A fifth conviction is a class B felony and is punished with up to 15 years in prison. With DUI convictions, even first-time offenders receive a license suspension. The suspension ranges from 90 days to a full year. Drivers who have a second or third DUI conviction face having their licenses revoked for another five to ten years, not including their other consequ... ... sure before you do drink, someone is assigned to be the designated driver and make sure that they are committed to not drinking any alcoholic beverages. As technology increases, there are more and more types of ways to prevent drunk driving. The use of ignition locks is growing in popularity and are trying to be mandatory for all vehicles. An ignition lock is a machine that is connected to a carââ¬â¢s ignition and checks the drivers blood alcohol content level. Installing an ignition lock in repeated violators cars is a possibility in many states. They would have to blow into the machine to start the car and also from time to time while driving. If alcohol is detected, the car either does not start or turns itself off. If a driver fails the test while the car is in motion, the vehicleââ¬â¢s horn will honk, or the lights will flash to get the attention of police officers.

Essay on Housing Vouchers More Than a Housing Solution
Housing Vouchers Vouchers: More Than a Housing Solution Introduction Many advocates and policymakers of housing for the poor believe that to achieve optimal human development of low-income households the location of the housing must be considered as well as the quality of the housing unit (Newman, 2008). According to Newman (2008), housing of the poor has to allow for economic independence and self-care while providing a safe and adequate place to live. The debate about decent housing alone is sufficient to provide a healthier living environment has its roots in the late 1920s, when the unhealthy environment of the slums was associated with numerous social ills. The hands-on approach of the housing and social service agencies wasâ⬠¦show more contentâ⬠¦For the past fifty years the shift from meeting the housing needs of the poor through government projects-based housing to a more individual approach, has been slowly implemented. Housing vouchers now enable underprivileged populations to move from high-poverty, segregated neighborhoods to more u n-segregated, low-poverty neighborhoods. Low-poverty neighborhoods have less crime, better opportunities for employment, and more diverse schooling options. Some housing advocates however, contend that housing assistance is unnecessary and is an income subsidy that should be combined with other social safety nets (Clark, W. 2008). Literature Review The Housing and Community Development Act of 1974 enacted a voucher program, the Section 8 Housing Allowance program that has since been renamed the Housing Choice Voucher program (HCV). In the original program vouchers were sent directly to qualifying landlords, however, in 1988, the terms were changed so that the tenants now receive the vouchers. Tenants were given more leeway in where and how the vouchers could be used (Teater, 2008). Teater (2008) explained that the original intent of the Section 8 program was to allow minority households to move to neighborhoods that were less racially segregated and safer. Three Day Road Essay Free Essays
Elijah and Xavier were always the best of friends. From the day they met at Residential School, they started to bond, and had a connection as strong as two brothers. However, they were eventually split apart, as Xavier had decided to fulfill his role as a bush Indian, and left with his Aunt Niska to live in the wilderness. We will write a custom essay sample on Three Day Road Essay or any similar topic only for you Order Now When years had passed, Xavier got lonely, and the only person he wanted to have by his side was Elijah; thus, their friendship was rekindled. Now, many years later, they still have not left each others side. They consider each other as brothers, and yet, Xavier ends up killing Elijah. In the book Three Day Road, it is clear that Xavier enables Elijahââ¬â¢s actions before and during war that lead to Elijahââ¬â¢s eventual death, causing Xavier to fall ultimately responsible for Elijahââ¬â¢s death. Without Xavier, Elijah would not have succeeded in war. He learned how to shoot, hunt and have killer-instinct from Xavier, turning him into an eventual heartless killing machine. The first example of Xavier being responsible for the training of Elijah comes from the first scene in the book, when both boys are out together for the first time. After hunting and effectively catching a marten, they suspect it to be dead. As they walk closer to the Marten, it is clear to both characters that it is still quite alive and struggling to break free from the trap that Xavier and Elijah had laid. Panicking, Elijah says: ââ¬Å"What do we do, Xavier? â⬠(2) Xavier quickly responds, without hesitation, by running towards the nearest log he can find, and brutally smashing the marten to death with it. Elijah, in shock, is told that it had to be done by Xavier. He believes him. It is clear that the first example of brutal violence that Elijah was exposed to before the war was both with and produced by Xavier. This one moment is what provoked eventual quotes from Elijah in the novel, such as: ââ¬Å"Killing is in my blood. â⬠(236). Without Xavier, Elijah wouldnââ¬â¢t have known how to kill an animal, let alone a man, therefore causing the battlefields of Europe to be no place for Elijah Whiskyjack. Xavier is a naturally quiet and passive person, which ultimately resulted in always allowing Elijah to continue on with his inhumane actions during the war. ââ¬Å"He seems to be spending more and more time with Grey Eyes, but I donââ¬â¢t ask much of itâ⬠(Xavier, 124). Elijah stating that, ââ¬Å"Scalping Fritz feeds my ungerâ⬠(312), and sharing that, ââ¬Å"I know you donââ¬â¢t like what happens next, so I wonââ¬â¢t give you the detailsâ⬠(Elijah speaking to Xavier about scalping, 286). Each of these quotations are examples in the book of Xavier hearing or witnessing something Elijah saying or doing. Xavier sees Elijah doing things morally wrong all the time, and consistently does nothing about it. He doesnââ¬â¢t even utter a word. When Grey Eyes started spending time with Elijah, Xavier automatically assumed that Elijah wouldnââ¬â¢t try morphine, as it ââ¬Ëisnââ¬â¢t in his natureââ¬â¢ to do such a thing. He did. When Xavier noticed the scalps piling up in Elijahââ¬â¢s army bag, he feared that something was wrong with Elijah. He feared even more when Elijah stated that scalping Fritz fed his hunger. But surely, thought Xavier, Elijah would not become Windigo; he did. As it is clear to see, Xavier did not voice his opinion at important stages in Elijahââ¬â¢s life. Perhaps if Xavier had simply told Elijah that Grey Eyes was not only a bad influence on him, but a bad person in general due to his heavy morphine use, Elijah would have listened to him and not hung around with Grey Eyes, and never become addicted to the drug. Maybe if Xavier had forced Elijah to stop scalping and take a breath from reality, Elijah would have realized that he was getting out of hand and stop taking Fritz scalps altogether. This way, he never would have turned Windigo. As you can see, there are two clear times in the novel where Xavier should have been a true friend and voiced his opinion towards Elijah about his problems, but not once did he do so. This caused Elijah to not see any problems with the things that he was doing or even realize what a terrible person he was becoming. It could have all been prevented. Xavier affected not only the events leading up to Elijahââ¬â¢s death, but literally was the one to kill him. In fact, he attempted to kill him twice. The first time was in an army tent. When Xavier suspected Elijah to be sleeping, he pulled out a needle filled with morphine from Elijahââ¬â¢s army kit. He plunged the needle into one of Elijahââ¬â¢s larger veins, but ended up not going through with the injection, as Elijah woke up confused, asking Xavier what he was doing. Xavier quickly responded, saying that he was giving him morphine, and then ââ¬Å"slowly pulled the needle from Elijahââ¬â¢s arm and placed it back in his kitâ⬠(323). This attempt of killing Elijah went miserably wrong, and caused Elijah to question whether or not he could trust Xavier as a friend anymore. It is clear that Xavier did not have the best track record with Elijah at this point. He trained him for War at a young age and did not speak out about both morphine addiction and scalping enemies. Furthermore, he attempted to kill Elijah with morphine, fearing that he had gone mad. By not going through with killing Elijah in the first place, it lead to him having to deal with him one on one in the middle of a crater on the battlefield (368-372). Elijah, knowing that Xavier would have killed him the first chance they were alone, planned to jump Xavier in the crater. Xavier, at this point, had no choice but to kill Elijah; the war machine that he himself had created. He ended up succeeding in this, only to find himself in a hospital days later. The all-out fight to the death between two best friends could have gone either way, however, it never should have occurred in the first place. If only Xavier had made different decisions in respect to Elijah as their friendship progressed, the death of Elijah never would have occurred. Xavier is ultimately responsible for the death of Elijah. How to cite Three Day Road Essay, Essay examples

Social Media Employees Fired for Facebooking
Question: Discuss about the term for Employees Fired for Facebooking. Answer: Introduction: The assignment deals with a case study that argues over the employees freedom on social media activity. In this assignment, a female employee named Tolu has been sacked from the organization because of her social media activity. The assignment critically analyzes the issue of monitoring employees apart from the workplace. Since social media is a modern revolution, many companies have tried to monitor their employee's activity on social media. The platform like Facebook, Twitter and Instagram are often checked by the organization to monitor their employees activity. However, many experts argue that it is not right at all. According to them, companies need to understand that professional and personal lives of employees are completely different from each other. The assignment analyzes the impact of social media monitoring can have on the employees. It also gives a brief description of the relevant theories to explain the unethical aspects of social media monitoring. The assignment also focuses on the concept like freedom of speech, personal rights to critically evaluate this issue. The phenomenon of social media sites such as Twitter and Facebook has alternatively influence concern, excitement and controversy among business anywhere. Many organizations have also started to monitor their employees activities on social media. Almost 750 million people are using Facebook and millions more using Instagram, Twitter to share their personal view. Therefore, companies are also using social media as a platform to monitor their employees activities. The case study describes an employee story named Tolu, who was terminated from her job because of her comment in Facebook. However, fired for online posting is not a new phenomenon. Many such examples are present where employees are fired because of her online posting against their companys culture or policy. However, in the case of Tolu, she does not comment anything wrong against her organization. Therefore, the termination decision of Tolu cannot be accepted at all. According to the First Amendment Rights, everyone has the right to share his/her thought on the social platform. However, it has seen that First Amendment protects employees from government organizations but not from of private organization. In Tolus case, companys decision of sacking her is against the National Labor Relation Act (NLRA). Not only that, there are number laws that have been initiated by the government over the years to restrict employers right to monitor employees personal life. NLRA protects employees rights to communicate their views on the social medium. Lately, National Labor Organization Board enforced the act and shown interest in right against employers to give freedom to the online activities of the employee. Hence, Tolu can obviously file a case against her organization against the injustice. Accord ing to the NLRB, Tolu has the right to say whatever she wants on her Facebook account. In addition, since Tolu has not shared any company information of Facebook, she has the right to have her jobs. However, it has been found that company search for reasons to terminate someone when they somehow do not like that particular employee. In Tolus case, may be the employer is looking for a reason to terminate her and the post in Facebook is just mere reason. Though it is unacceptable, many organizations have found to practice this. In this case, Tolu was completely devastated by the management decision. She felt that it is completely within her personal rights to post or comment whatever she wants. On the other hand, from an organization point of view, employee monitoring is crucial because it not only involves employee activities but also the reputation of the company. But checking employees personal information or questioning someone's blog that has no relation with the organization is completely unethical. In Tolus case, company not only questioned her blog or comment but it was used a factor to terminate her, which is completely illegal. In addition, this kind of decision of the organizations will have negative impact on the other employees as well. As they might feel that, the company is getting into their personal lives as well. This will not help the organization to maintain their reputation (Drouin et al. 2015). The primary objective of the organization regarding monitoring employees activities on social networking is to monitor weather they have any activity against their organization or not (Delaney 2013). It includes the activities like sharing confidential information of the organization, harassing any other employees of the company on the social forum publicly, etc. According to the law, employees this kind of practices are treated as an illegal offense and can be penalized for that. However, Tolu does not say anything wrong against the organization or employee and the in that particular comment she does not mention any name also. Hence, no judiciary system of the world can support the Tolus termination. Here, a recent case of AstraZeneca can be mentioned as well. A senior level employee of AstraZeneca has recently found to share his negative view regarding the culture of the organization on the social media platform that actually affecting the reputation of the company. Here management team of the organization tries to resolve the issue very sincerely by simply warning him. The management also takes step to educate that particular employee about the negative outcome of this. It works very well for the organization and it able to resolve the issue without any problem. But in the case of Tolu, the management do not even warn her for single time and also the employees of the organization not even informed about the organizations initiatives on employee monitoring (Crane 2011). This reflects that the organization has a poor staff communication process as well. It clarifies that management does not really bothered about the importance of communication among different levels of employees. Therefore, Tolu was completely unaware of the fact that her company is taking initiatives on checking employees personal social networks account. Hence, this even makes a strong case for Tolu to get back her job on her legal rights. In modern business structure, all the organizations are seriously engaging with the issue of use of social networking sites by the employees and have adopted several approaches do deal with the issue (Holbrook 2011). However, most of the companies do not have a direct policy on the use of social networking sites by the employees, but it does have policy regarding general internet use. HRMC does provide specific guidelines on the use of social networking that include the whole company. The guidance is based on the organizational policies on this area, such as its policy on bullying and code of conduct. It also conveys a key massage that every employee need to follow the standard code of conduct and online behavior as would be expected offline (Greenhouse 2010). Hence, policy regarding uses of social media at the workplace is a major cause of concern for every organization. Therefore, employee guidelines for use of social media advocates a wider policy before it is finalized (Thomson 2009). For example, guidance provided by Acas to the employees on formulating social media policy state that "it is up to the employees to understand the impact of their social media activity on the organizational reputation". HRMC believes that right policy formulation regarding use of social media in the workplace will help to ensure that employees can add their input into the policy, which will in turn increase the overall awareness and acceptation of the organizational policy (Sloop and Gunn 2010). It is very important for the organization to understand the usefulness of the employee feedback regarding organizational social networking policy (Waymer and VanSlette 2013). Otherwise, it might have an immense adverse impact on the organizational health and cultu re. According to a survey by HRMC, it is important for organizations to understand the employee perception on the use of social networking sites before implementing any policy regarding this (Teitel 2012). The acceptable use of policy has certain type of behaviors that employee associated with the organization must have to display (Schmidt and OConnor 2015). For example, it is ideal to illustrate British telecom policy regarding use of social networking at the workplace. The policy of British Telecom is mostly related with the issues of human resource management. The matters related to social media use are classified under security measures. Hence, the policy is integrated with security policy of the organization. Human Resource policy sate that online conduct is similar as offline conduct and many things that employee thinks is private but actually it is not. However, there is certainly a line between employees professional and private lives. With the improvement of information communication technology, it provides a greater scope for the organizations to monitor their employees in workplace (O'Connor and Schmidt 2015). New methods like video monitoring, web and email monitoring is implemented in organizational practices. Furthermore, the increase in the use of social media has tempted the companies to monitor their employees social media activity. This causes the issue that employers might use personal information specially information regarding their life outside the workplace against their job performances. According to Jacobson and Tufts (2013) employers concerns over the organizational security is somewhat justify some degree of monitoring. Hence, companies need to keep it balance and fair about employee monitoring. Lucero, Allen and Elzweig (2013) state that fair approach of employee monitoring must have following approach: Necessity Principle: employee monitoring only need to be taken place where organization needed to prevent defamatory or illegal acts and consideration should be given to other counter-productive efforts of monitoring. Hence, employee monitoring outside the workplace is not been considered under the necessity principles. Finality Principle: monitoring of employees in the organizational structure need to have well defined specific purpose Proportionality Principle: the degree of the employee monitoring have to be proportionate to the expected harm of the activity that organization intended to prevent. Transparency Principle: organization must completely aware the employees about what the organization monitors, what kind of approaches they took and what is the reason behind employee monitoring. International Labor Organization (ILO) suggests organizations a way to ensure monitoring policies to keep up with these principles (Nguyen 2014). It suggests that organization needs to negotiate with the employees before implementing any rules regarding employee monitoring on social media sites. Since policies that are negotiated among the employees are more likely to be accepted and it will help the organization to maintain a healthy organizational culture (OLeary et al. 2015). Organizational policy regarding employee monitoring on social sites does not suggest that it has the right to monitor employees personal photographs or posts (O'Brien 2011). Hence, management of the organization needs to be careful about regarding this modern issue of the organization that might have negative impact on the organization and ultimately affect the reputation of the company. Conclusion: The study concludes that the use of social networking sites like: Facebook, Twitter and MySpace by the employees have significantly grown in past few years. Therefore, organizations are also taking these social platforms as a source of employee monitoring. Since monitoring social accounts of the employees gives organization a chance to monitor their employees activities outside the workplace as well. Social network monitoring also enables organizations to have a close look weather its employees are part of any activities or not that might have a negative impact on the company reputation. The study identifies the importance of having a clearly stated single policy for the employees regarding employee monitoring. This will help the organization to avoid any situation like Tolus incident where she was caught completely unaware. The case study also highlighted the employees rights to communicate their personal views. However, it has also identified that productivity of the employee has f allen because of the use of social media platform like Facebook on workplaces. Therefore, organizations have to monitor their employees but they also have to consider the fact that monitoring employees on workplace and outside the workplace are completely two different things. Hence, organizations need to draw a line between organizational goals and employee private life so that it can able to build a healthy organizational culture. References: Crane, C., 2011.
